Piano Storage Terms and Conditions - Resonant Piano
1. Parties and Agreement These Terms and Conditions (“Agreement”) govern the storage of the piano(s) described in the associated order, invoice, or Stripe subscription (“Piano” or “Goods”) by Resonant Piano (“Company,” “we,” “us”) for the customer named on that order or subscription (“Customer,” “you”). By signing, clicking “I agree,” or providing payment information for storage, you accept this Agreement in full.
2. Ownership and Authority You represent and warrant that you are the legal owner of the Piano or are in lawful possession of it and have full authority to place it in storage. You confirm there are no liens, mortgages, or other encumbrances that would prevent storage under this Agreement. You will notify us immediately of any change in ownership or claims against the Piano.
3. Description of Services We will store the Piano in a secure, climate-controlled facility that maintains appropriate temperature and humidity levels for pianos. Storage is provided on a month-to-month basis unless a different term is agreed in writing. We may store the Piano with legs removed and properly protected, or on legs, at our discretion based on space and instrument type, unless otherwise agreed in writing.
4. Storage Fees and Payment
  • Monthly storage fee: As quoted or as shown on your invoice or Stripe subscription.
  • Fees are due in advance on the 1st of each month (or on the billing date set in your Stripe subscription).
  • Payment is made automatically via the payment method you provide through Stripe.
  • Late payments may incur a late fee of $20 or $20% of the monthly fee, whichever is greater, after 10 days past due.
  • We reserve the right to increase rates with 30 days’ written notice.
  • All fees must be current before the Piano will be released.
5. Lien Rights You grant us a general lien on the Piano for all unpaid storage charges, moving charges, and related expenses. If charges remain unpaid after the notice period required by Montana law, we may sell or otherwise dispose of the Piano at public or private sale to recover amounts owed, following the procedures required by applicable Montana law. You will remain responsible for any deficiency.
6. Condition of the Piano / Inspection Upon intake we will note the visible condition of the Piano (and may photograph it). You acknowledge any pre-existing damage or condition listed in our intake notes. We are not responsible for pre-existing issues, normal wear, or natural aging of the instrument (including wood movement, finish changes, string corrosion, or similar effects).
7. Insurance and Liability Resonant Piano carries insurance that covers loss of or damage to the Piano while it is in our care and storage, up to a maximum of $75,000.
You are not required to maintain additional insurance for any Piano valued at $75,000 or less. This coverage is included as part of our storage service and is one of the advantages of storing your instrument with a piano specialist rather than a general storage facility.
If the Piano is valued at more than $75,000, you must obtain and maintain your own additional insurance for the amount exceeding $75,000.
Our liability for any covered loss or damage is limited to the actual cash value or the cost of reasonable repair of the Piano, whichever is less, and in no event more than $75,000.
We are not responsible for damage or loss caused by:
  • Acts of God, natural disasters, war, or other events beyond our reasonable control, or
  • Pre-existing conditions, internal mechanical issues, or normal aging of the Piano that are not the result of our negligence.
8. Access and Release Access to the Piano is by appointment only. We require reasonable advance notice (typically 48–72 hours) for release or inspection. The Piano will be released only to you or a person you authorize in writing, and only after all charges are paid in full. Moving and release fees are separate and will be quoted at the time of request.
9. Term, Termination, and Abandonment
  • This is a month-to-month agreement unless otherwise stated in writing.
  • Either party may terminate with 10 days’ written notice, provided all fees are current.
  • If storage fees remain unpaid for more than 60 days, we may treat the Piano as abandoned after giving the required legal notices under Montana law and may sell or dispose of it in accordance with Montana Code Annotated § 70-6-607.
  • You remain liable for all charges up to the date the Piano is released or sold.
10. Prohibited Items and Use The storage space is for the Piano (and any agreed accessories) only. No hazardous materials, flammables, perishables, or other property may be stored with the Piano without our prior written consent. The Piano may not be used or played while in storage except by mutual written agreement.
11. Notices All notices under this Agreement may be sent by email to the address you provided or by certified mail. You agree to keep your contact information current with us.
12. Entire Agreement and Governing Law This Agreement (together with any specific quote, intake form, or Stripe subscription details) constitutes the entire agreement between us. It is governed by the laws of the State of Montana. Any disputes will be resolved in the courts of Flathead County, Montana.
13. Acceptance By providing payment information, clicking “I agree” on the Stripe checkout page, or signing below, you acknowledge that you have read, understand, and agree to these Terms and Conditions.
